Types of Post-Decree Modifications We Handle

Child Custody & Parenting Time

Child custody modifications address who the child lives with, how time is divided, and who makes major decisions about the child’s life. Courts grant these only when the proposed change serves the child’s best interests, which means the facts you bring to court need to be specific and credible, not just a general complaint about the current arrangement.

Child Support

A significant shift in either parent’s income, a change in the number of overnights, or a meaningful change in the child’s financial needs can all support a child support modification. Under Utah law, the threshold depends on timing. If the order is three or more years old, the proposed change generally needs to produce at least a 10% difference from the current order. If the order is newer, Utah law requires at least a 15% difference along with a substantial change in circumstances. Either way, the underlying change must be expected to last, not just a temporary gap or short-term fluctuation. Filing promptly matters: a modification can take effect as of the month following the date the petition was served, which can protect against owing the original amount while the case works through the court.

Alimony

Either spouse’s significant change in financial circumstances can justify an alimony modification, including job loss, retirement, or a substantial income increase. The receiving spouse’s remarriage or death terminates alimony automatically under Utah law. Cohabitation with a new partner can also terminate alimony, but the paying spouse must first establish that fact before the court. All other changes in circumstances require a court order to take effect.

Relocation With Minor Children

If a parent intends to move more than 150 miles away, Utah law generally requires at least 60 days written notice to the other parent before relocating, subject to the specific terms of the existing order. A move of that distance often triggers a modification to the parenting plan, either through agreement or through a contested hearing.

Stipulated Modifications

What Utah Courts Require Before Granting a Modification

What typically doesn’t qualify: minor income fluctuations, short-term job gaps, or general dissatisfaction with how the original agreement turned out.

For custody modifications, Utah courts apply a two-step analysis. First, did a substantial change occur? Second, does the proposed modification serve the child’s best interests under factors including safety, parent-child bonds, stability, and the child’s individual needs? Both steps must be satisfied for the court to grant relief.
